Notification

Only a bailiff can proceed to serve your legal documents in Quebec. These may include, among other things, putting in default letters, formal notices or requests from the Tribunal Administratif du logement (rental board).
Serving a document means notifying another person that a court action (a case) has started or that a case has reached a certain stage. Service is usually done by sending electronically a document to someone or delivering it to them in person. The fact of entrusting this task to a judicial officer has an assured positive impact.
Service by a bailiff is likely to lead to a faster settlement of your dispute. An additional guarantee that contributes to your cause!
By entrusting this task to the bailiff, you have authentic proof that your document was delivered with certainty to the right person.

Examples of types of document or legal procedure served:

  1. Request relating to non-payment of rent
  2. Request to modify the lease
  3. Request for eviction from the tenant after the end of the lease
  4. Request for repossession of housing
  5. Appendix for additional information
  6. Request for relocation compensation and damages
  7. Formal notices

Observation

Also offered in terms of observation. Although little known, this service has undeniable advantages as it can generate positive impacts that can go as far as quickly ending a conflict situation, and even before an action is taken. The observation is in fact a powerful tool. The impartiality of our bailiffs and their experience lead to findings that are fair and faithful to reality. In the context of a trial, the report (a report with or without photos) provided by a bailiff constitutes probative force and can have a powerful effect and compelling evidence..

 For example, a bailiff’s report may be required to establish the state of premises, noise or insalubrity, presence of animals, lack of heating in the winter, verify work, etc.

Execution of decisions

Once the Tribunal administratif du logement has rendered a decision ordering the eviction or expulsion of a tenant the bailiff completes a notice of execution, files the notice in the office of the Court of Québec with a copy of the decision and serves the notice to the debtor (defaulting tenant).  Should the debtor (defaulting tenant) not obey the order (notice to vacate the dwelling) only then does the bailiff execute the court order to physically evict all occupants of the dwelling along with their personal possessions and give back possession to the owner.
